Hi Justin,
the best way to protect a digital business from competition is always to try to go faster, and do things better.
Nowadays, there is no real value spending time when you are building an innovative product to work on patents or any other kind of IP protection as it needs lot of effort/time/resources to do so, for in fact a very small chance to be valuable and useful.
The best protection stays to be better and always being in advance on your market.
Of course, there are always exceptions in some businesses and products area where R&D has been expensive to create a key and unique solution to a problem. But world is moving fast, and even here, there is the recent example of the idea spreaded by Elon Musk when he decided to make all their Tesla patents public for their competitors; the spirit behind was the fact it is better to have competition to make the market evolves in the good direction, knowing that Tesla has also a timing advance in their execution and product.
In our own case, with a SaaS Product and mainly based on Web Software Engineering solutions, we can also mention this can be a hard challenge to protect with patents software in the EU, compared to what is possible in the US.
